Draft Cannabis Regulations: How much is "too much"?

The Department of Justice and Constitutional Development has published Draft Cannabis Regulations for public comment. These regulations are meant to give practical effect to South Africa’s evolving cannabis laws. Since the Constitutional Court decriminalised private adult use, cannabis has become legal for personal consumption in certain circumstances. But legal does not always mean simple.

Summary:

Imagine getting into a taxi, Uber, or lift club, and being asked: “Are you carrying cannabis?”

Not because it’s illegal – but because new proposed government regulations may soon require transport operators to monitor, question, and control how cannabis is carried from one place to another.

These new regulations attempt to set rules around:

  • Personal Possession
  • Cultivation
  • Transportation
  • Record Expungement
  • Enforcement
