The Immigration Amendment Bill: Influence key immigration reforms

Dear South Africa (DearSA) strongly encourages all South Africans to make their voices heard on the proposed Immigration Amendment Bill [B8 – 2024].

According to Nolu Hlophoyi, spokesperson for DearSA, this bill is currently under consideration by the National Assembly. The Portfolio Committee on Home Affairs invites stakeholders, interested persons and parties to make written submissions on the Immigration Amendment Bill [B8 – 2024] by 22 November 2024. “This bill proposes significant changes to South Africa’s immigration laws, and public input is needed to ensure that immigration policies reflect the needs and concerns of South Africans,” Hlophoyi added.

The Immigration Amendment Bill, 2024 introduces vital updates to the Immigration Act of 2002, driven by constitutional court rulings to ensure fair, efficient, and humane immigration processes. The amendments propose that any foreign national detained under immigration laws must appear before a court within 48 hours of arrest, enhancing the rights of detainees through direct court access and the right to legal representation. “These measures are designed to align South Africa’s immigration laws with constitutional standards, promoting respect for human rights and efficient immigration management,” said Hlophoyi.

In addition to procedural protections, the bill includes progressive new measures, such as the introduction of a remote work visa, an improved work visa application process, and expanded provisions for changing visa status under exceptional circumstances. “This reflects South Africa’s responsiveness to a dynamic, globally connected world, and its commitment to a fair and accessible immigration system,” Hlophoyi added.
